Trump right to go after ‘deep state’

A recent headline leaped out at me: “Trump officials insist on picking Cordray’s substitute.”

Imagine the nerve of President Donald Trump to assert control over the unconstitutional and out-of-control Consumer Finance Protection Bureau. But wait — Article 2 of the Constitution provides that “the executive power shall be vested in a president of the United States of America.” Oops — there’s no exception to this plenary grant of power for either Dick Cordray or the CFPB. As Obama said, elections have consequences.

Cordray — a political hack who served as attorney general of Ohio before Ohio’s voters sent him packing — and the Consumer Finance Protection Bureau are part of the “deep state”: unelected bureaucrats who wield immense power over every aspect of American life.

The CFPB was created by the Obama-Pelosi-Reid crew in 2010 (a period that also gave us Obamacare and which blessedly led to the end of Democrat majorities in Congress). The court has already held the structure of the CFPB to be unconstitutional. The CFPB’s funding mechanism is also unconstitutional (it just takes money from the Federal Reserve when it feels like it, without any Congressional appropriation). Finally, Cordray was initially appointed director through an unconstitutional recess appointment. Seems like a trend, doesn’t it?

Good for Trump. In fact, Sen. Mitch McConnell and Rep. Paul Ryan should go into recess and Trump should immediately appoint his new CFPB director — then take his sweet time in finalizing the appointment over Sen. Chuck Schumer’s whining and obstruction. Drain the swamp.
