Is it legal in SC to ride in the bed of a pickup truck? Here’s what the law says
On a late weekend night or during a game day, it’s not an uncommon occurrence to drive past a truck with people packed in the back in Columbia.
Sort of a southern tradition in South Carolina, it’s a bonding activity that makes driving with friends even more special. But of course, there are always some restrictions.
Due to safety risks, SC law prohibits certain individuals from sitting in the open bed of a truck. Here’s what the law says about the seating arrangement:
SC motor vehicle laws
Adults and teens over 16 years of age can freely sit in the open bed of a truck with no legal consequences, but do so at their own risk.
It’s a different story for kids.
Under the South Carolina Code of Laws, Section 56-5-3900, it’s unlawful to transport anyone under 15 years of age in the open bed or open cargo area of a pickup truck or trailer. A bed or cargo area is considered open if it’s without permanent overhead restraining construction.
Some exceptions allow kids to enjoy a windy ride in the bed of a truck. Section 56-5-3900 doesn’t apply when:
- An adult is present in the bed or cargo area of the vehicle and is supervising the child
- The child is secured or restrained by a seat belt installed to support a load of not less than 5,000 pounds for each belt, and of a type approved by the Department of Public Safety
- An emergency situation exists
- The vehicle is being operated in an organized hayride or parade pursuant to a valid permit
- The vehicle is being operated while hunting or in an agricultural practice
- The vehicle is being operated in a county that has no incorporated area with a population greater than 3,500
- The vehicle has a closed metal tailgate and is being operated at less than 36 miles per hour
A person violating the law is guilty of a misdemeanor and, upon conviction, must be fined 25 dollars. Driver’s license points or insurance surcharges will not be affected for breaking this law.
Safety tips for being in the back
Even if it’s allowed, being in the bed of a truck while on the road can be extremely dangerous. Here are some tips to protect yourself and others:
- Ensure you are aware of your surroundings and take precautions to prevent falls
- Always prioritize safety and consider alternative transportation, when possible, especially for younger individuals
- Sit on the floor and stay seated during the entire drive
- Keep speeds slow and avoid highways
- Be aware that injuries can occur from falls, collisions and exhaust exposure
