A grand jury will decide whether to charge a Hilton Head Island teenager with a more serious offense in connection with a single-vehicle accident that left one person dead on Christmas, according to the 14th Circuit Solicitor's Office.
A prosecutor is reviewing evidence with the S.C. Highway Patrol, according to Daniel Brownstein, spokesman for the Solicitor's Office. Their findings will be presented at 19-year-old Matt Zitello's indictment, tentatively scheduled for Jan. 23, and the grand jury will decide whether to amend his charge to felony DUI resulting in death, Brownstein said.
Zitello was charged with felony DUI resulting in great bodily injury Dec. 25 after the car he was driving in Hilton Head Plantation overturned, critically injuring his 19-year-old passenger, Vianery Garcia.
Garcia died Saturday as a result of her injuries. Zitello was also charged with one misdemeanor count of possession of beer or wine by a minor.
