Master in EquityÂ's NOTICE OF SALE 2014-CP-07-00779 BY VIRTUE of a decree heretofore granted in the case of: Branch Banking and Trust Company vs. Harvey A. Dobson, Jr., a/k/a H. Alvin Dobson, Jr.; Kimberly Ann Dobson a/k/a Kimberly A. Dobson, et al., I, the undersigned Marvin H. Dukes, III, Master in Equity for Beaufort County, will sell on Monday, August 4, 2014, at 11:00 a.m., at the County Courthouse, 102 Ribaut Road, Beaufort, SC 29901, to the highest bidder: All that certain piece, pared or lot of land designated as Lot 6 of Fort Places Estates Subdivision, on a plat prepared by Gasque & Associates, Inc., Land Surveyors-Planners recorded in the Office of the Register of Mesne Conveyance in Beaufort County in Plat Book 65 at page 119, generally bounded as follows, to-wit: on the North by Lot 7 of Fort Place Estate Subdivision as shown on said plat; on the East by Lot 10; on the South by Lot 5 of Fort Place Estates as shown on said plat; and on the West by a road proposed as Fort Freemont Lane as shown on said plat; having such shape, form, courses, distances, buttings and boundaries as are more fully shown on the above described plat and reference is hereby craved to said plat and the same is incorporated herein. This being a portion of the property conveyed Harvey A. Dobson, Jr., and Kimberly Ann Dobson by Deed recorded in the Office of the Register of Mesne Conveyance for Beaufort County in Deed Book 694 at page 2334. Also conveyed herein is a 1/27th interest in a lot containing .66 acres, more or less, designated as Parcel A and a portion of Fort Freemont Subdivision, on a plat dated February 13, 1998, revised April 30, 1998, prepared by David L. Gasque, R.L.S., and recorded May 6, 1998 in the Office of the Register of Mesne Conveyance in Beaufort County in Plat Book 65 at page 16, generally bounded as follows, to-wit: On the North by Lot 1 of the Bessie F. Sanders Subdivision, now owed by James M. Davis and Susan F. Davis; on the East by the right-of-way of Fort Freemont Road, in the South by Fort Freemont Subdivision; and on the West by the high water mark of the run of the Beaufort River; and having such shape, form, courses, distances, buttings, and boundaries as are more fully shown on the plat above described; reference is hereby craved to said plat and the same is incorporated herein. This being a portion of the property conveyed to Harvey A. Dobson, Jr., and Kimberly Ann Dobson by Deed recorded in the Office of the Register of Mesne Conveyance for Beaufort County in Deed Book 944 at page 237. IT IS THE INTENT OF THE GRANTOR BY CONVEYING THE UNDIVIDED INTEREST IN THIS LOT THAT THE GRANTEE HAVE USE OF THE LOT FOR THE PURPOSE OF ACCESS TO THE BEAUFORT RIVER. THIS CONVEYANCE IS SUBJECT TO RESTRICTIVE COVENANTS RECORDED IN THE OFFICE OF THE REGISTER OF MESNE CONVEYANCE IN DEED BOOK 985 AT PAGE 2137 AND AS AMENDED AND RECORDED IN DEED BOOK 1040 AT PAGE 560. This being the same property conveyed to H. Alvin Dobson, Jr., and Kimberly A. Dobson by Deed of J. Wyman Wall, III dated November 17, 2000 and recorded November 21, 2000 in Book 1356 at Page 947 in the ROD Office for Beaufort County. TMS No. 30003500001690000 Property address: 116 Fort Fremont Road, St Helena Island, SC 29920 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity, at conclusion of the bidding, five percent (5%) of said bid is due and payable immediately upon closing of the bidding, in certified funds, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff's debt in the case of non-compliance. In the event of a third party bidder and that any third party bidder fails to deliver the required deposit in certified (immediately collectible) funds with the Office of the Master in Equity, said deposit being due and payable immediately upon closing of the bidding on the day of sale, the Master in Equity will re-sell the subject property at the most convenient time thereafter (including the day of sale) upon notification to counsel for Plaintiff. Should the last and highest bidder fail or refuse to comply with the balance due of the bid within 30 days, then the Master in Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on Master in Equity's Deed. The successful bidder will be required to pay interest on the balance of the bid from the date of sale to date of compliance with the bid at the rate of 6.49% per annum. The Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. The sale shall be subject to taxes and assessments, existing easements and restrictions of record. The sale will not be held unless either the PlaintiffÂ's attorney or the PlaintiffÂ's bidding agent is present at the sale and either the PlaintiffÂ's attorney or the PlaintiffÂ's bidding agent enters the authorized bid of the Plaintiff for this captioned matter. In the alternative, PlaintiffÂ's counsel, if permitted by the Court, may advise this Court directly of its authorized bidding instructions. In the event a sale is inadvertently held without the PlaintiffÂ's Counsel or CounselÂ's bidding agent entering the authorized bid of the Plaintiff for this specifically captioned matter, the sale shall be null and void and the property shall be re-advertised for sale on the next available sale date. This sale is subject to all title matters of record and any interested party should consider performing an independent title examination of the subject property as no warranty is given. Neither the Plaintiff nor its counsel make representations as to the integrity of the title or the fair market value of the property offered for sale.
