NOTICE OF FORECLOSURE SALE BY VIRTUE OF A DECREE by the Honorable Marvin H. Dukes, III, heretofore issued in the case of Legends Horizontal Property Regime vs. Marlene L. Willis a/k/a Marlene Bergin a/k/a Marlene Willis-Bergin, et al., Civil Action No.: 2013-CP-07-01677, the undersigned will sell the following property on August 4, 2014 at 11:00 a.m., in the Office of the Master-In-Equity for Beaufort County, South Carolina, located at 100 Ribaut Road, Beaufort, South Carolina, to the highest bidder: ALL that certain Apartment, lying and being in Hilton Head Island, Beaufort County, South Carolina, known as Apartment 626 The Legends Horizontal Property Regime, and being more particularly shown and described by reference to the Master Deed, as many be amended or annexed, of The Legends, LLC, establishing said Horizontal Property Regime, said Master Deed being dated the 5th day of May, 2005, and being recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Book 2146 at Page 91 on May 10, 2005. PIN: R510 009 000 1026 0626 Address: 112 Union Cemetery Road, Unit 626 Hilton Head Island, SC 29926 TERMS OF SALE: For cash. The successful bidder, other than the Plaintiff, will deposit with the Clerk of Court for Beaufort County, at the conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to PlaintiffÂ's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of bid or comply with the other terms of the bid within thirty (30) days, then the Clerk of Court for Beaufort County may resell the property on the same terms and conditions on some subsequent Sale Day (at risk of the said highest bidder). Seven and One-Quarter per cent (7.25%) simple interest shall be paid on the bid balance until the date of compliance, or the then-prevailing statutory judgment interest rate.
