Syria's chemical attack meets constitutional test

The Constitution of the United States, Article 1, Section 8, Powers of Congress, includes:

"To define and punish piracies and felonies committed on the high seas and offenses against the law of nations."

Doesn't the repeated use of chemical weapons qualify for our Congress to consider this a heinous crime and offense?
